WinkElf (WE) is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining.
If you spot a listing that you feel is violating the terms and conditions of this website or any other applicable laws such as trademark or copyright infringement, please let us know by contacting us.
RIGHT TO SUSPEND OR TERMINATE
You agree that WinkElf, in its own discretion, may terminate any auction or use of the service immediately and without notice if
- We believe that you are not abiding by the general rules of this web-site,
- You have repeatedly broken a certain term,
- You have listed a suspicious item or
- We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing while we investigate further. If our investigation is conclusive then your account with us may be terminated.
MEMBERSHIP
Membership with WinkElf is only available to those you can form a legally binding contract. This web-site does not permit minors (under 18 years of age) to register. If any member fails to signup with their correct age the account may be terminated immediately.
PROPER CONDUCT
You are solely responsible for the contents of your actions through WinkElf. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.
You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation.
GENERAL TERMS
WinkElf acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.
In addition, please note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence. WinkElf shall not be responsible for any items sold whether using Buy Me (buy-it-now) or Wink Me (make an offer), for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. WinkElf shall not be responsible for the cost of procurement of substitute goods or any losses resulting form any goods purchased or obtained.
WinkElf assumes no liability for the content of the listings. However if you fall victim of a fraudulent transaction we will assist you as much as we can.
WEBSITE RULES
Item Types - WinkElf was created to promote and provide a venue for artisans of handmade or hand designed items. For storekeepers, we do permit listing not-by-hand items. Under store type, please select "handmade" for your handmade goods and "brand name" for any other items. Items tagged as "brand name" will appear in your store only. They will not be integrated into the main categories and searches. In so doing, we can maintain our handmade focus while giving sellers a place for all their goodies.
Featured Listings - All sellers can add Featured Listing as a listing option. These items will appear on the main page or category pages depending on the feature type selected. We also that only one of duplicate items be features at a time to keep the content fresh and interesting for all our guests.
Links - Off site links are not permitted in listings or in store. Offsite links are permitted on your Me page and in the Community Center forums and groups. Links include any url format in text or image format that designates a location outside the village.
Inactive Stores - Only active stores will be listed in the Shop by Store drop down menu. We reserve the right to suspend stores found to be inactive for a period of 6 months or more. It's no fun for buyers to be enticed into a store only to find that nothing is available.
Listings, stores and content pages may be edited accordingly.
TRANSACTION DISPUTES
Please report Non-Payment Transactions only after 14 days from the purchase date. All fees (where applicable) will be reimbursed to the seller. In such cases WinkElf will leave negative feedback for buyer indicating that payment was not made. The buyer will not be permitted to leave return feedback.
In cases where an error was made, both seller and buyer must agree to cancel the transaction by email.
Feedback extortion is not permitted and will result in suspension. No exceptions. Please report feedback extortion.
LAWS & JURISDICTION
Our website Terms & Conditions shall be governed by and constructed in accordance with the laws of United States and Canada and any disputes will be decided only by the Courts of United States and Canada.
